**Tech Companies Face Lawsuit Over Alleged Role in Radicalizing Shooter**

Reacting to the ruling, both Reddit and YouTube expressed their disagreement and intention to appeal the decision. This issue has even made its way to the Supreme Court. The Buffalo lawsuit, however, takes a different approach by labeling YouTube and Reddit’s algorithms as a “defective product,” bypassing Section 230. If the court agrees, this could subject these companies to a new set of laws that hold manufacturers accountable for dangerous products.
Despite Monday’s decision, the question remains unresolved. The judge mentioned that the defendants could still argue that their platforms functioned as mere message boards, thus falling under the protections of Section 230 and the First Amendment.
Prior to the May 2022 attack, the shooter’s extensive use of social media, influenced by algorithms, exposed him to harmful content, leading to his radicalization. The lawsuit alleges that YouTube’s algorithm and autoplay features guided him towards hateful and violent videos. Similarly, Reddit’s algorithm directed him to communities that fueled his extremist beliefs, ultimately contributing to the attack at Tops.
Both Reddit and YouTube have emphasized their efforts to combat extremist and hateful content by investing in technology for content detection and removal. Reddit’s spokesperson stated, “We are continuously enhancing our image-hashing systems and monitoring our platform’s communities to ensure compliance with our guidelines.”
As the appeals proceed, the claims against YouTube and Reddit will advance to the discovery stage, allowing for the collection of evidence and witness testimonies. The lawsuit will also target other defendants, including an arms manufacturer and the gun shop that sold the weapon to the shooter.
Payton Gendron, the shooter, received a life sentence without parole on state charges and faces federal hate crime charges. Federal prosecutors, in a first for the Biden administration, have announced their intent to seek the death penalty in this case.
